Before using this site, please review the following Terms and Conditions (“Terms”).  ProSeUniversity.com (“Website”) is an internet service (“Service”) owned and operated by Pro Se University PS.  (herein referred to as “we,” “us,” “Pro Se University,” or “Pro Se University PS”).  The purpose of this website is to provide legal information to individuals representing themselves (“pro se parties”) in family law matters in King County Superior Court, Washington State. 

Use of this site constitutes acceptance of these Terms and creates a binding legal agreement between you (the adult user of this service) and Pro Se University PS wherein you agree to use this website in a manner consistent with and according to the following Terms and all applicable laws.  Please note that any breach of this agreement may result in the termination of our service to you.

Pro Se University PS reserves the right to change these Terms at our discretion.  Please refer to our website occasionally for any changes.  If you do not agree with any of these Terms, don’t use this service.

When you purchase services from Pro Se University PS, you will be asked to provide some personal information, such as your name, e-mail address and mailing address.  We will protect  this information and use it only as provided for in our Privacy Policy.

SERVICES AVAILABLE FROM PARALEGAL SUPPORT: 

  • Assistance with the secretarial aspects of document assembly.
  • Assistance to a mediator and to the parties to schedule a settlement conference and provide secretarial support during the settlement conference.
  • Information on what forms are needed and where to get them.
  • Information on court rules, procedures, and case schedules.
  • Review of forms after you fill them out to make sure they are complete.
  • Information on court and community resources.

SERVICES NOT AVAILABLE FROM PARALEGAL SUPPORT:

  • Legal advice.
  • Assistance in trial preparation.
  • Assistance to people who are represented by attorneys.
  • Assistance to people who are uncertain what kind of legal action they need.
  • Filling out your papers for you or telling you how to fill them out.

Attorney Support (Unbundled Services or Limited Representation).  Washington State allows attorneys to provide unbundled legal services in family law matters.  This is also called “limited representation” and it means that an attorney can limit the scope of his or her representation of a client.  There are risks and benefits to unbundled legal services.  If you retain Pro Se University PS to provide unbundled services, then we may rely on your representation of the facts, unless we have reason to believe that the factual representation is false or materially insufficient.

YOU ARE RESPONSIBLE FOR THE FOLLOWING:

  •             Payment at or before the time you receive “Attorney Support” services.
  •             Gathering information about your case.
  •             Making your own decisions and carrying them out.
  •             Signing and filing your own pleadings.
  •             Meeting court-imposed deadlines.

WE CAN DO THE FOLLOWING:

  •             Coach you and make suggestions.
  •             “Ghostwrite” pleadings for you. 

 We will have limited responsibilities to you.  You will have an attorney-client relationship during the time that you meet with us.  However, that relationship terminates when the meeting ends and you cannot represent to other parties in your case or to the court that you have an attorney of record from Pro Se University PS because you do not.

About Your Account

This site is not intended for persons under the age of 18.  Our products and services are for use and purchase by adults only.  By providing Pro Se University PS with any information, you represent that you are 18 years of age or older.  If you provide us with information regarding a third party, you represent that the third party is 18 years of age or older.

During your use of our website, you may be asked to select a Username and Password.  You agree to provide Pro Se University PS with accurate and complete registration information.  You also agree to provide Pro Se University PS with accurate and complete information about you in connection with your usage of our website and services.  Impersonation of any person or entity or false statements or misrepresentation about yourself or your affiliation with any other person or entity is a breach of this agreement and shall provide Pro Se University PS with a basis to terminate your access to the site and Pro Se University services.

You are solely responsible for all activity or usage on our website initiated by you.  Online conduct that Pro Se University PS, at our sole discretion, deems to be fraudulent, harmful, or otherwise illegal may result in the termination of your access to the site.

You hereby grant Pro Se University PS permission to access your account to perform our services for you; to expand new and useful services and/or features; and to follow a court order, complaint, subpoena or legal request from a governmental authority.

Pricing and Payments

Updating Your Credit Card Information.  You agree to notify Pro Se University PS of any change to your credit card information, including but not limited to, changes in account number, expiration date or billing address.  Pro Se University PS shall not be responsible for any charges made by the credit card issuer to your credit card account for exceeding credit limit, insufficient funds or other reasons.

Late/Non-Payments.  If any charges for the services are due but unpaid for any reason, including but not limited to, declined credit card charges or non-payment, Pro Se University PS may terminate the services and all accumulated charges shall be immediately due.  No termination or suspension of the services or of this Agreement shall relieve the  user of the obligation to pay any amounts due.

Refund Policy.   

Webinars.  The information provided during the Webinars is intended for general informational purposes only, is not legal advice, and does not create an attorney-client relationship.  No refund shall be given to participants who disagree or are unsatisfied with the information provided. 

It is the sole responsibility of the Webinar participant to verify that he or she has the skill level, technical ability and equipment to log into and participate in the Webinar on the correct date and time of the event.  No refund shall be given due to the participant’s inability to log into or participate in the Webinar because of a technical or equipment failure originating from the participant’s location.

If a participant cannot log into or participate in the Webinar because of a technical or equipment failure originating from Pro Se University PS, then the participate shall have the choice between a refund of the Webinar fee or participation in the same Webinar on its next-scheduled date.  All requests for refunds or replacements must be made by no later than fourteen (14) days from the date of the scheduled Webinar.

Seminars.  The information provided during the Seminars is intended for general informational purposes only, is not legal advice, and does not create an attorney-client relationship.  No refund shall be given to participants who disagree or are unsatisfied with the information provided.

It is the sole responsibility of the Seminar participant to arrive on time and at the correct location for the Seminar.  No refund shall be given if the participant misses the Seminar for either of these reasons, or because of weather events or natural disasters.

If you cannot participate in the Seminar because of a technical or equipment failure or a problem with the location of the Seminar originating from Pro Se University PS, then you shall have the choice between a refund of the Seminar fee or participation in the same Seminar on its next-scheduled date.  All requests for refunds or replacements must be made by no later than fourteen (14) days from the date of the scheduled Seminar.

Courthouse Tours.  The information provided during these Tours is not legal advice, and does not create an attorney-client relationship.  No refund shall be given to participants who disagree or are unsatisfied with the information provided.

It is the sole responsibility of the Tour participant to arrive on time and at the correct courthouse location for the Tour.  No refund shall be given if the participant misses the Tour for either of these reasons, or because of weather events or natural disasters.

If you cannot participate in the Tour because of a technical or equipment failure or a problem with the location of the Tour originating from Pro Se University PS, then you shall have the choice between a refund of the Tour fee or participation in the same Tour on its next-scheduled date.  All requests for refunds or replacements must be made by no later than fourteen (14) days from the date of the scheduled Tour.

Paralegal Support.  Anyone who uses the paralegal services provided by Pro Se University PS acknowledges and understands that these services do not constitute legal services or legal advice.  No legal advice is provided or intended to be provided by the paralegal.  No refund shall be given to participants who disagree or are unsatisfied with the paralegal services provided.

It is the sole responsibility of the Paralegal Support user to arrive on time and at the correct location for the scheduled Paralegal Support.  No refund shall be given if the user cannot use the scheduled Paralegal Support for either of these reasons, or because of weather events or natural disasters.

If you cannot use the Paralegal Support services because of a technical or equipment failure or a problem with the location of these services originating from Pro Se University PS, then you shall have the choice between a refund of the Paralegal Support services fee or use of these services at a newly scheduled date acceptable to both you and Pro Se University PS.  All requests for refunds or replacements must be made by no later than fourteen (14) days from the date of the scheduled Paralegal Support services.

If you cannot use the Paralegal Support services because Pro Se University PS discovers that there is a conflict of interest between you and another Pro Se University PS client, former client, or other person, then you shall receive a full refund immediately upon discovery of the conflict.

Attorney Support (Unbundled Services or Limited Representation).  It is the sole responsibility of the Attorney Support user to arrive on time and at the correct location for the scheduled Attorney Support.  No refund shall be given if the user cannot use the scheduled Attorney Support for either of these reasons, or because of weather events or natural disasters.

If you cannot use the Attorney Support services because of a technical or equipment failure or  a problem with the location of these services  originating from Pro Se University PS, or because Pro Se University PS discovers that there is a conflict of interest between you and another Pro Se University PS client, former client, or other person, then you shall have the choice between a refund of the Attorney Support services fee or use of these services at a newly scheduled date acceptable to both you and Pro Se University PS.  All requests for refunds or replacements must be made by no later than fourteen (14) days from the date of the scheduled Attorney Support services.

If you cannot use the Attorney Support services because Pro Se University PS discovers that there is a conflict of interest between you and another Pro Se University PS client, former client, or other person, then you shall receive a full refund immediately upon discovery of the conflict.

Disclaimer of Warranties

YOUR USE OF THIS WEBSITE IS AT YOUR SOLE RISK.  The content, products, and services available through Pro Se University PS’s website are provided on an “as available” and “as is” basis and without any warranty of any kind, expressed or implied.

Pro Se University PS and our third party suppliers disclaim all warranties and conditions of any kind, whether expressed or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.  Pro Se University PS makes no warranty regarding the performance of this website or service.  Pro Se University makes no warranty regarding any materials downloaded or otherwise obtained through the use of the service, goods, services, or special offers.  Pro Se University PS disclaims any warranties for any information, advice or tips obtained through the website.  Pro Se University PS similarly disclaims any warranties for other services or goods received through or advertised on this website or received through any links provided in this website.

Limitation of Liability

Under no circumstances shall Pro Se University PS be liable to any user for any indirect, incidental, special, punitive or consequential damages, including but not limited to, damages for loss or delay of use, lost profits, loss of data, or other intangibles that result from the use, inability to use, and reliance on Pro Se University PS’s website, products or services, from any changes to this website or its services, or from unauthorized access to or alteration of your transmissions or data.  Some jurisdictions do not allow the limitation of liability.  Therefore, some of the above limitations may not apply to you.

Indemnification

As a Pro Se University PS customer, you agree to indemnify Pro Se University PS, our officers, directors, employees, consultants, suppliers, and any third-party information providers to the service and hold them harmless from and against all damages, losses, and expenses, including attorney’s fees, arising from any violation of these Terms or any event associated to your account (including negligent or wrongful conduct) by you.

Governing Law

These Terms and Conditions shall be interpreted, construed and governed by the laws of the state of Washington and the federal law of the United States of America.  Both parties hereby consent to jurisdiction and venue in the courts of King County, Washington.

Modifications to Terms of Service

Pro Se University PS, at its sole discretion, has the right to revise these Terms at any time.  Modifications will be posted on the website.  If any portion of these Terms or any changes to these Terms are unacceptable to you, it is your responsibility to discontinue use of the service and website.  Continued use of the service and ProSeUniversity.com verifies your acknowledgement and acceptance of the current Terms.

Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Pro Se University PS with respect to this service and therefore supersede all other communications, written, oral, or electronic, with regard to the service.
